आरोपी को बचाव का मौका देने के लिए उसके सामने अभियोगात्मक सामग्री रखना आवश्यक, सुप्रीम कोर्ट का फैसला

"अभियोगात्मक सामग्री (incriminating material) को अभियुक्त के समक्ष रखा जाना चाहिए, जिससे आरोपी को अपना बचाव करने का उचित मौका मिले। यह 'ऑडी अल्टेरम पार्टम' के सिद्धांतों के अनुरूप है।" यह टिप्पणी सुप्रीम कोर्ट ने एक केस की सुनवाई के दौरान की। सुप्रीम कोर्ट ने यह दोहराया है कि जो भी अभियोगात्मक सामग्री साक्ष्य में सामने आई है, उसे दण्ड प्रक्रिया संहिता की धारा 313 के तहत उसके परीक्षण के दौरान अभियुक्त के सामने रखी जानी चाहिए, जिससे आरोपी को अपने बचाव का पूरा मौका मिले।
